Federal Court Mandates Freedom of Abrego Garcia from Immigration Detention

A federal judge has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, finding his continued detainment is without lawful basis.

"Since his release after erroneous imprisonment in El Salvador, he has been re-detained, again without legal justification," the judge wrote in her ruling.

The case originates in a erroneous removal to El Salvador earlier this year, which US authorities later acknowledged was an error. Following his repatriation to the United States to answer human smuggling allegations, he was detained in federal detention.

In her decision, the court pointed out that the government lacks a valid deportation order, which prevents them from deporting Mr. Abrego Garcia "for now."

The legal proceedings involve disputed claims. While the Trump administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently disputes this claim.

He has also pleaded not guilty to the smuggling charges, which are part of a ongoing trial in the state of Tennessee.
